Terms of service

1. What these terms cover

These terms govern the market-data service of adona-robot.com and api.adona-robot.com, supplied by Adona Robot Sàrl ("we"), identified in the legal notice, to a company or a person acting for their business ("you"). The service is not offered to consumers.

Creating an account accepts these terms, and so does paying for a plan. The figures of each plan (price, connections, slices, instruments, history) are those of the published price table, and the interface is the one described in the API reference; a change to either that is less favourable to you follows the section on changes below. Both form part of these terms.

2. Account and key

An account is opened with a company email address that you confirm. You keep your password and your key confidential: the key stays on your server and never goes into a browser. Every call made with your key counts as yours, including after a leak until you rotate it from the account page.

One account per company. Opening several accounts to obtain more trials than the rule below allows, or to split a usage that belongs on one plan, is not allowed.

3. Free trial

One trial per company in any 12 months, and per network in any 30 days, for 7 days from the key's issue, within the limits shown on the account page. It is free and needs no card. It ends by itself, and nothing is charged when it does.

4. Prices, billing and cancellation

Prices are in Swiss francs (CHF), per month, as published on the price table. They exclude value added tax. Swiss VAT is added at the legal rate for a customer established in Switzerland or Liechtenstein; a business established elsewhere pays no Swiss VAT and accounts for VAT itself (reverse charge), as its invoice states. A company number is asked at payment. Payment is by card through Stripe. The plan is paid in advance: the first payment covers the rest of the current month, and the subscription then renews on the 1st. The continuous feed and any correction of the plan are billed after the month they concern, as set out below. Invoices are on the billing page, reached from the account page.

Your plan follows your monthly reading, peak connections and slices, on the next invoice and never mid-month, a closing invoice aside; a lower plan applies only after a month at least 90% measured. If you cancel, your plan runs to the end of the month and the closing invoice arrives on the 1st: it counts as that next invoice, for the month just ended. If the subscription ends earlier (a key cut off for more than 24 h, by you or by us; a blocked account; an unpaid invoice), it comes within minutes and reads the month up to then. Either way, if that reading calls for a higher plan than the one paid, the closing invoice carries the difference, in full and not prorated; the correction only goes up, never a refund.

The continuous feed is billed as published in the continuous feed section of the price page, on top of the plan.

If a payment fails, the service continues while our payment provider retries it. If the invoice is still unpaid when those retries end, the subscription ends and the paid access stops. You cancel at any time from the billing page, with no commitment; the cancellation takes effect at the end of the month, as the rule above says. A month already paid is not refunded.

5. Use of the data

On every paid plan you may show the data in your product, relay it to your own clients and keep what you receive. The trial is for testing an integration. There is no bulk export: history is read through the metered API only.

You answer for your clients and for the use they make of the data, including any regulatory obligation that applies to your activity. Prices are supplied for information. They are not an offer to deal and not investment advice, and they are not meant as the sole basis of a trading decision.

You may not get around a limit of your plan, attack or overload the service, or use it for an unlawful purpose.

6. Availability and support

We run the service to be available around the clock, but no plan carries an availability figure. Interruptions can occur, for maintenance or because of an incident. As published, one-second candles lost during an incident are not reconstructed; one minute and above are. A moment our service was down is never billed as continuous feed.

Support is given by email, on business days in Geneva, to one named contact on your side. It is not given to your end users. The Enterprise plan adds an answer to every request within 24 h and a dedicated support agent.

7. Suspension and end of the contract

We may cut off a key or block an account, without notice, if it is used against these terms, if the key appears to have leaked, if an invoice stays unpaid, or if the law requires it. When we cut a key because it appears to have leaked, we write to you and issue a new key on request. On a paid plan, a cut that lasts ends the subscription under the rule in section 4.

We may also stop supplying the service to you at the end of a month, by giving 30 days' notice by email. A month already paid is then served to its end.

8. Liability

The data comes from third-party sources and is supplied as received, without a guarantee that it is complete, exact or on time.

To the extent Swiss law allows, we are not liable for slight negligence, nor for indirect loss, such as lost profit, trading losses or loss of data. In every other case our liability is limited to the amounts you paid us in the 12 months before the event. Liability for intent or gross negligence is not limited.

9. Changes

We may change these terms and the prices. A change that is less favourable to you is announced by email at least 30 days before it applies, and you can cancel before that date. Using the service after that date accepts the change. A change in your favour may apply at once.

10. Personal data

Personal data is handled as described on the privacy page.

11. Governing law and courts

These terms are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods. The courts of Geneva have jurisdiction. These terms exist in English and in French; if the two differ, the French text prevails.
